Privacy Policy

Shine is designed to make it easy for team members to share ideas and issues. In order to do this, we need to collect and process personal data. This Privacy Statement provides you with an overview of the type of personal data that we collect and process as well as other terms and conditions relating to the use of Shine.

Introduction:

This Privacy Statement governs the use of the software application Shine (“Application”) for mobile devices that was developed by Orchard MBC ApS and licensed to your workplace (the “Company”. The Application is developed for company employees. The Purpose of the Application is to allow team members to easily report/share/communicate about issues, opportunities, ideas and other work-related matters.

As Shine is managed from an admin panel, most personal data, such as your name, location and phone number derive from that admin panel which in some cases can be integrated with the company’s HR-system. Therefore, if you want to know more about what type of personal data that is contained in the system please contact your manager or your company’s Data Protection Officer.

Basic Terms

  • You are expected to comply with all security protocols in place at the Company as well as adhere to the Company’s Privacy Statement. Please advise your local manager to for your Company’s Privacy Statement.
  • All content shared on this Application must be handled confidentiality and in accordance with the Company’s confidentiality.
  • You may not post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content via the Application.
  • You are responsible for any activity that occurs through your account.
  • You must agree to not solicit, collect or use the login credentials of other Shine users.

Collected Data

Here is an overview of the personal data that we collect and why:

FULL NAME

If not provided by yourself or your manager in the admin panel, this is typically pulled from the connected HR-system. If your profile is removed from the admin panel or HR-system (e.g. when you are no longer with the Company) your name in the Application will be changed to “deleted user”.

USERNAME

If not provided by yourself or your manager in the admin panel, this is pulled from the connected HR-system. If your profile is removed from the admin panel or HR-system (e.g. when you are no longer with the Company) your username in the Application will be changed to “deleted user”.

E-MAIL

If not provided by yourself or your manager in the admin panel, this is pulled from the connected HR-system, if available on your profile. We show this in the Application, so colleagues can reach out via email if needed. If your profile is removed from the admin panel or the HR-system (e.g. when you are no longer with the Company) your e-mail in the Application will be deleted.

PHONE NUMBER

If not provided by yourself or your manager in the admin panel, this is pulled from the connected HR-system, if available on your profile. We show this in the Application, so colleagues can reach out via phone if needed. If your profile is removed from the admin panel or the HR-system (e.g. when you are no longer with Company) your phone number in the Application will be deleted.

PROFILE PICTURE

This is added by yourself in the app but is not required. If your profile is removed from the admin panel or the HR-system (e.g. when you are no longer with the Company) your profile picture in the Application will be deleted.

ORGANISATION

If not provided by yourself or your manager in the admin panel, this is pulled from the connected HR-system.

LOCATION(S)

If not provided by yourself or your manager in the admin panel, this is pulled from the connected HR-system. To associate your personal data with “Location(s)” is necessary (especially in regard to multi-site/location companies) to ensure that the content you create in the Application also sits with the right location(s).

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, your type of mobile device (model and manufacturer), your mobile device’s unique device ID, the IP address of the mobile device, the mobile operating system and version, country, language, time zone and information about the way the you use the Application.

This Application does not collect precise information about the location of your mobile device (GPS-tracking).

We may disclose the Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect the user’s safety or the safety of others, investigate fraud, or respond to a government request.

Please note that you may withdraw your consent to our processing of your personal data at any time, by uninstalling the Application, but that this will not impact the legality of any processing completed prior to the revocation.

How We Use Your Personal Data

We process your personal data in order to: 1. comply with the law, as well as anything that we are required or authorized by law to do; 2. resolve any legal and/or commercial complaints or issues; 3. Fulfil the Purpose of the application as described above; 4. facilitate our business operations, including performing other functions and activities relating to the business of the Company and improve the Company’s services. 

“Processing,” means using cookies on a computer/handheld device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.

We may occasionally share your personal data, for any of the reasons mentioned above, with third parties. Such third parties include: other Company entities, agents, external advisors, our external service providers and contractors (such as any mail provider, commercial agent or support services), government agencies including law enforcement, regulatory and dispute resolution bodies (or any other body to whom disclosure is required by law or court/ tribunal order), and any other person or entity to whom disclosure is authorised by you. When we disclose your data to a third party that is processing personal data on our behalf, we take all reasonable steps to ensure that those third parties are bound by confidentiality and legal obligations with respect to the protection of your personal data. If necessary, we may transfer your personal data within the Company’s entities, and to our operations or contractors located outside the EU/EEA. However, any such transfer does not change of our commitment to safeguard your personal data under this Privacy Statement and ensure compliance with all applicable Data Protection Regulation.

Data Retention Statement, Managing Your Information

All submitted text, images and video submitted by you belong to the Company. Additionally, all activity conducted by you in relation to the image, video and text submitted and uploaded to the Application by you and other users is owned by the Company and will be handled in accordance with the Company’s Data Retention and Deletion Standard. Please advise your local manager for where to find the Company’s Data Retention and Deletion Standard.

We will retain the provided data for as long as you use the Application and for a reasonable time thereafter. If you would like us to delete the data provided, please contact us at support@orchard.dk and we will respond within a reasonable timeframe. Please note that some or all of the provided data may be required in order for the Application to function properly.

Children

We do not use the Application to collect personal data from children under the age of 13 or to market services to such children. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@orchard.dk. We will delete such information from our files as soon as reasonably possible.

Security

We are committed to safeguarding the confidentiality of your personal information. We provide physical, electronic, and procedural safeguards to protect the information we store and process. For example, we limit access to personal information to authorized employees and contractors who need the information in order to operate, develop or improve our Application. You are expected to comply with all security protocols in place. The confidentiality of all content shared within the Application follows the same confidentiality agreements in place at the Company.

Access to Your Personal Data

We take reasonable steps to ensure that the personal data we process is accurate, up to date, relevant and complete. Therefore, you should contact us if you believe that the personal data that we are processing about you is inaccurate. You may also object to our processing of your personal data, request access or request for us to restrict our processing.

We may review, amend or revise our Privacy Statement and the way we process personal data from time to time. Therefore, you are advised to consult this Privacy Statement regularly for any updates and changes.
